End User License Agreement
PLEASE READ THIS AGREEMENT CAREFULLY.
THIS END USER LICENSE AGREEMENT ("AGREEMENT") IS BETWEEN MARKET WEST AND YOU, AN INDIVIDUAL OR AN INDIVIDUAL ACTING ON BEHALF OF YOUR EMPLOYER, A CORPORATION, PARTNERSHIP OR OTHER LEGAL ENTITY ("USER") THAT WILL BE USING MARKET CITY PRICING INFORMATION ("SERVICE"). THIS AGREEMENT GIVES THE USER THE RIGHT TO ACCESS AND USE THE PRICING INFORMATION COLLATED BY MARKET WEST AND PROVIDED BY MARKET CITY WHOLESALERS AS PER THE TERMS STATED IN THIS AGREEMENT.
MARKET WEST IS WILLING TO GRANT THE USER THE RIGHT TO ACCESS AND USE THE SERVICE ONLY IF THE USER ACCEPTS ALL OF THE TERMS OF THIS AGREEMENT AND HAS PROVIDED MARKET WEST WITH ALL THE REQUIRED INFORMATION PRIOR TO REGISTRATION.
BY CLICKING THE "I AGREE" BUTTON BELOW AND ACCESSING THE SERVICE, THE USER ACKNOWLEDGES THAT THE USER HAS READ THIS AGREEMENT, UNDERSTANDS IT, AND AGREES TO BE BOUND BY IT. IF THE USER DOES NOT AGREE TO ALL OF THE TERMS IN THIS AGREEMENT, THE USER SHOULD NOT ACCESS OR OTHERWISE USE THE SERVICE BECAUSE NO LICENSE SHALL HAVE BEEN GRANTED THERETO.
1. THE USER'S REGISTRATION OBLIGATIONS
In consideration of use of the Service, the User agrees to: (a) provide true, accurate, current, and complete information about the User as prompted by the registration form; and (b) to maintain and update this information to keep it true, accurate, current, and complete. If any information provided by the User is untrue, inaccurate, not current, or incomplete, Market West has the right to terminate the User's account and refuse any and all current and/or future use of the Service.
2. CONFIDENTIALITY
The information provided by the Service may contain legally privileged and confidential information that must not be reproduced, altered or re-distributed, except with the express permission of Market West.
4. DISCLAIMER AND LIMITATION OF LIABILITY
(a) The User expressly agrees that use of the Service is at user's sole risk. The Service is provided on an "as is" and "as available" basis.
(b) Market West makes no warranty that the Service will meet user's requirements or that the Service will be uninterrupted, timely, secure, or error free; nor does Market West make any warranty as to the results that may be obtained from the use of the Service.
(c) The User agrees that Market West shall not be liable for any indirect, incidental, special or consequential damages resulting from the use of, or the inability to use, the Service, nor for costs arising from commercial agreements entered into or decisions made based upon information provided by the Service.
